Terms & Conditions
Please read through the terms and conditions on our website thoroughly before enrolling. When enrolling as a student of Franchester Williams Media LLC you agree to the terms and conditions as laid out on Franchester Williams Media LLC website www.fwmediallc.com.
GENERAL
All purchases of services (classes, workshops, events) are non-refundable.
Purchases of products are only refundable in new and unused condition up to 10 days after purchase.
All students must have a unique online account associated with a unique email address. Friends and family members may not share the same email address.
Because Franchester Williams Media LLC’s rates are already much less expensive than all other studios in the area, no discounts will be given on class packages, intro offers, or unlimited packages.
Every effort is made to hold class on time. The schedule is subject to change without prior notice. Please check the online schedule for the most up-to-date schedule. Franchester Williams Media LLC is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed, or canceled for any reason.
Please arrive at least ten minutes before class.
Please check in at reception before each class.
Payment must be made upon booking. No students will be permitted to sign-up for a class, workshop, or event as unpaid unless it is a free or donation-based class. Unpaid classes or membership payments will be back-charged.
Franchester Williams Media LLC is not responsible for the safekeeping of your personal belongings.
The front doors will be locked 10 minutes into every class. For safety reasons, no one 10 or more minutes late for class is permitted entry and leaving class early is strongly discouraged.
It is the responsibility of the student to notify teachers of any previous injury, illness, or conditions that may impact their practice.
Classes at Franchester Williams Media LLC may be physically strenuous and you voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death.
You will follow all instructions given to you by Franchester Williams Media LLC teachers and you acknowledge that any failure to do so will be at your own risk and may cause injury.
In attending classes at Franchester Williams Media LLC, you agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Franchester Williams Media LLC or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.
Franchester Williams Media LLC reserves the right to refuse entry.
Prices may increase from time to time to reflect increases in cost and benefits.
Terms, Conditions, and Fees are subject to change without prior notification.
By booking into a class you automatically agree to the above terms & conditions.
CLASS CANCELLATIONS & BOOKING ETIQUETTE
If you do not show up for a class, you will be charged for it and you will be removed from the class. If there is an exception to this rule, it will say so in the description of the class as well as at the time of purchase. For these exceptions, you will be fully charged for a class that you sign-up for and do not attend or the class will be removed from your package. Students with unlimited packages will be charged the single drop-in rate for no-showing to a class under these terms.
Workshop and event cancellations must be made 24 hours prior to the start of the reserved workshop or event. If you do not attend or cancel within 24 hours of the start time, you will be fully charged for the workshop and will not be able to use the credit for a future workshop.
Workshops, events, and trainings are non-refundable.
Credits will not be provided for enrollments canceled by students.
Please cancel if you are unable to attend a class or workshop to make your space available to others.
Photography Classes
Gear to bring: camera, memory card, extra batteries. If you do not have a camera, we have a limited amount of cameras to lend you (and waiver form & fee will apply). SD Card can be purchased for $15.

Class Packages With Set # of Classes
Class packages that have yet to be used may have the amount of the package transferred to an account credit or a different package as long as any difference is value is paid upon transfer
10 Class Packages will expire 6 months after first use.
5 Class Packages will expire 3 months after first use.
Class packages may be shared between students. The same expiration dates apply to shared packages.
Unlimited Packages
Unlimited weeks, months and years may not be shared.
Unlimited months expire 30 days after activation.
Unlimited years expire 365 days after activation.
Unlimited packages that have yet to be used may have the amount of the package transferred to an account credit or a different package as long as any difference is value is paid upon transfer.
Introductory Offers
Our new student specials are only available to brand new students, no matter how long it has been since you have been to a class Franchester Williams Media LLC.
Only one per student is permitted.
All promotions are non-transferable and non-returnable and cannot be shared.
Clients found to be buying the Intro offer more than once will be suspended and charged any additional class costs they may have incurred.
Monthly Auto-Renew Memberships
Monthly auto-renews cannot be shared.
You will be charged $850 or $1,500 (depending on your plan) on the same day of each month for your auto-renew.
Membership fees will automatically be charged to your credit card.
You can update or change your credit card in your online account or in the studio.
Auto renews can be frozen for up to 2-months per calendar year (January-December) unless you have a note from a doctor. Your subsequent monthly auto-payment will shift forward by a commensurate number of calendar days. Pause requests must be made in writing by emailing contact@fwmediallc.com. Please allow 48 hours to process the request.
Your auto-renew can be canceled at any time in writing by emailing contact@fwmediallc.com. If you cancel, you may lose your existing rate. Please allow 48 hours to receive and process your cancelation request.
If your monthly auto-payment fails for any reason, then your membership may be cancelled and/or you may be assessed a fee.
It is your responsibility to ensure there are sufficient funds available to cover the monthly auto-debit. Should a payment be declined for any reason, Franchester Williams Media LLC reserves the right to process payment at any time to settle any debt owed.
Franchester Williams Media LLC is not responsible for additional bank fees that you may incur from your bank. Bank fees are under the terms and conditions of contractual agreements that lie between you and your bank.
If auto-debit payments fail for 2 payments or more, Franchester Williams Media may cancel the membership and you will be ineligible to sign-up for an auto-renew membership in the future.
All account debts must be settled before cancellation of membership can be finalized, this includes all late cancellations and no-show fees incurred.
We reserve the right to cancel memberships.
GIFT CARDS
Gift cards can be redeemed for classes, workshops, programs, account credit, and/or retail purchases.
Gift cards can be purchased and sent electronically through our online store or in-studio.
Gift cards are non refundable and not redeemable for cash.

Franchester Williams Media LLC and www.fwmediallc.com will only contact individuals who specifically give us consent. Consent may be given by contacting us through our website, creating an account on Franchester Williams Media LLC text message consent through Square, or by purchasing one of our products or services.

Your information can only be accessed by Franchester Williams.
Your full name, postal address, cell phone, email address, emergency contact name and phone number, and date of birth, provided by you when registering to schedule and purchase classes at Franchester Williams Media LLC.
This information is stored on Franchester Williams Media LLC. It is used as a way to contact you about account issues and promotions, and as a means of providing safe service to you. Click here for Franchester Williams’s privacy policy.
Your Information can be accessed by Franchester Williams and the front desk staff at her studio.
If you would like any of your information deleted, please email fwilliams@fwmediallc.com
You may be asked to store your credit card information. This will be completely voluntary and used to more easily sell you services from The Yoga Ground.
If you subscribe for the monthly auto-renew you will be asked to give consent to store your credit card information for future billing. Should you ever cancel your auto-renew, you can email fwilliams@fwmediallc.com to delete your stores information.
All such information is strictly protected and used only for delivering the content and products the user has signed up for or purchased. This information is never used for other purposes and is never shared with 3rd parties for their own use. This data can be deleted at the request of the consumer as long as it is in compliance with the signed contract.
Processors/Vendors Used Who Collect Information:
Franchester Williams and www.fwmediallc.com, uses some processors/vendors to run as a business. These include:
1. Squarespace to create account, schedule classes, make purchased, and collect automatic payments.
2. MailChimp to create emails and promotions.
3. Squarespace to host our website.
4. GoogleDrive to store email lists
www.fwmediallc.com does not share your information with these processors/vendors. Information will only be provided to these processors by YOU in order to sign-up at these sites. The information collected by these processors is stored by them. Click the links to be taken to the privacy policies of the associated processors.
Existence of Individual rights:
As a consumer of products and services offered by Kristen Brunello and www.theyogaground.com, you have the right of:
Access to your personal data – to know what data is stored where.
To correct personal data where it is incorrect or incomplete
To delete personal data as long as it is not necessary to uphold your signed contract
Restrict/suspend processing of personal data in compliance with your signed contract
Complain to a supervisory authority
Withdraw consent at any time unless doing so goes against what was agreed upon in your signed contract
Object to processing in compliance with your signed contract
Anonymous Usage History (non-Personal Data)
This information is strictly limited to the history of activities that you engage in while on our site. It does NOT include any personally identifiable information (PII).
The purpose of this information is to improve your experience.
For example, by storing the fact that you have already taken the free recovery archetype quiz, we don’t need to have that pop-up appear again.
There is a small subset of this history that we use with 3rd parties, such as Google or Facebook, for the purpose of measuring and improving the efficacy of advertising campaigns.
Some of these third parties, aggregate such information across many websites. This allows them to identify users who are more likely to be interested in specific offerings like fashion, sports, education and so on. Please see the privacy policies of Google and Facebook for more information.

Photography
IINVOICES:
Franchester Williams Media LLC will invoice the client after the completion of the project or service. The client agrees to pay invoices by the due date specified or funds will be deducted from the card on file within 24 hours after service completion.
DEPOSIT MUST BE PAID 72 HOURS BEFORE SHOOT/FILM DAY. NO LAST MINUTE PAYMENTS, YOU WILL HAVE TO RESCHEDULE.
NO SHOW POLICY:
If the client books an appointment and does not cancel within 48 hours of the appointment, the client will be charged a non-refundable $50 as a no-call, no-show fee.
PAYMENT METHOD:
Payments will be made to Franchester Williams Media LLC via cash, Venom, major card credits or an approved payment card determined by Franchester Williams Media LLC.
NON-REFUNDABLE DEPOSIT:
The client will pay a non-refundable deposit for the date of service. The client can change the date of service 72 hours in advance if needed. Anything after 72 hours will result in a new non-refundable deposit for another service date.
EXPENSES:
Clients who require on-location services will be required to pay additional travel expenses for location 5+ miles away from the studio location.
The client will reimburse Franchester Williams Media LLC for any damage of equipment, in the event that Franchester Williams Media LLC equipment is damaged during service or project.
FINAL PAYMENT POLICY:
Final payment is required before the shoot.
Photos will not be sent until full payment is received.
RESHOOT POLICY:
No reshoots will be considered or provided while there is an outstanding balance. Clients are not entitled to a reshoot due to poor decisions (bad makeup, clothing choices, etc.)
LATE ARRIVAL POLICY:
If the client is 15 minutes or more late an additional fee of $50 will be added to the final payment.
If the client does not want to pay an additional late fee, the client can rebook but will be required to pay another non-refundable deposit.
